OVER-THE-COUNTER GUN SALES

Champion Arms is a Federal Firearms Licensed (FFL) business and must adhere to Federal laws and ATF regulation pertaining to the purchase of firearms. All firearms purchased by Texas residents may be transferred to the owner upon completion of a Form 4473 and required NICS background check provided approved identification is produced at the time of purchase. The NICS background check requirement may be waived if the purchaser holds a current, unexpired, state issued, License to Carry (LTC). If a “Delayed” response is provided by NICS background check, the firearm(s) must remain in the possession of Champion Arms until notified by NICS to “Proceed,” or the proscribed wait time has passed, before transferring the firearm to the owner. Once a NICS background check has been cleared to “Proceed,” the customer has 30 days to return to Champion Arms, with proper identification, to retrieve their purchase. The customer may NOT send another person to pick up a firearm(s) and must retrieve the item(s) in person. If 30 days pass without picking up the firearm, the background check will expire and a new background check will be required.

**NO ITEMS MAY BE ADDED TO A FORM 4473 AFTER A PURCHASE/NICS BACKGROUND CHECK HAS BEEN INITIATED. ADDITIONAL PURCHASES WILL REQUIRE A NEW FORM 4473 BE COMPLETED AND NICS BACKGROUND CHECK BE CONDUCTED**

Champion Arms is also a Class 3 dealer of NFA items. Although it is not required, nor will it speed up the processing time, we recommend starting a Gun Trust to simplify managing your NFA item(s). Customers cannot take possession of NFA item(s) until ATF issues a Tax Stamp (must be purchased at an additional cost) for each NFA item. A Tax Stamp is obtained by completing an ATF background check. Champion Arms can assist Texas residents in obtaining a Tax Stamp. However, we have no bearing on the time it takes for ATF to complete their assessment. Also, much of the initial paperwork to file for a Tax Stamp must be completed by the customer including providing proper identification, fingerprints by an approved agency, valid photograph and other required documents and forms to process the NFA purchase. ATF will not start a background check until ALL REQUIRED DOCUMENTS have been submitted to ATF for processing. Once a Tax Stamp has been approved, the customer must bring a valid picture ID and fill out a Form 4473 for the item(s) but will not require a NICS background check because an ATF background check has already been completed. The customer must pick up the item(s) in person and may NOT send someone to pick up an NFA item(s).

If the purchaser is an out of state resident (as reflected on identification), the firearm(s) and/or NFA item(s) will be transferred to an FFL/Gun Store within the customer’s state of residence for processing the Form 4473. We will try to accommodate a transfer to an FFL/Gun Store of the customer’s choice. However, we must abide by legal requirement for shipping/transferring NFA items and firearms. NFA items may only be transferred to another Class 3 dealer with a valid Special Occupational Tax (SOT). Please keep this in mind when determining which FFL/Gun Store to send NFA item(s). Customers should know their local/state regulation concerning the legalities of owning firearms or NFA items in their state of residents. This will be helpful in reducing delays in transferring items.
